Mailing List Management Policy
MarketAccess is a registered member of the The
Coalition Against Unsolicited
Email (CAUCE)
MarketAccess does not sell, rent, barter, give, or use in any way, shape or
form, email addresses that we maintain, to anyone, for any reason.
MarketAccess does not collect nor store any personal data, like name, address,
credit card information, etc. for list subscribers. MarketAccess only has each
subscriber's email address, and which list they joined. All lists are independent.
MarketAccess does not claim any copyrights on messages passing through our
system.
Each mailing list is run by individuals and companies, and they, the list
owners, own their lists and can use the list in any way they decide. All of
our list owners are equally fanatical about guarding the privacy of list subscribers.
The list owners pay MarketAccess a fee to deliver email to list subscribers.
The list owners are responsible for the addresses on their list, and the contents
of the messages they post to the list.
If you have questions about your email address or the content of any messages
sent to the list, please contact the list owner of your mailing list.
Privacy on the Internet can be difficult, and once an email message is sent
out to a list of subscribers, there's no telling where it will end up. In addition,
if the list has the optional web archive, or otherwise gets posted on the web,
the email may be indexed into a search engine.
If you are a subscriber to a list run by MarketAccess, there are Unsubscribe
directions at the bottom of each message. Or you can contact the list owner
to get off any list run by MarketAccess.
If you are still having troubles getting off a list, please print off a copy
of the email and send via the Post Office, to:

Prohibited Content Policy
In an effort to maintain the highest levels of email mail delivery and IP
reputation, as well as to adhere to various provincial, federal, and international
laws, MarketAccess prohibits the use of any MarketAccess services by
any individual, company, or website that engages in any of the following:
- Manufactures, markets, sells or offers to sell the following products
or content (or services related to the same):
- Pornography or illicitly pornographic sexual products. This includes
but is not restricted to magazines, videos, software, and related sexual
products.
- Escort and dating services;
- Illegal goods and materials;
- Illegal drugs and illegal drug contraband;
- Pirated computer programs or related software;
- Instructions on how to assemble or otherwise make bombs, grenades
or other harmful weapons
- Displays or markets material that exploits the health and well being
of children, or otherwise exploits children under 18 years of age
- Posts or discloses any personally identifying information or private
information about children without their consent (or their parents consent
in case of
a minor)
- Manufactures, markets, sells or offers to sell products, services,
or content frequently associated with unsolicited commercial email, a.k.a.
spam.
Examples
of such industries include;
- Online and direct pharmaceutical sales. This includes but is not
restricted to health and sexual well being products
- Personal 'work at home' offers promoting "get rich quick / build your
wealth / financial independence". This includes but is not restricted
to; the solicitation of participants to be involved in pyramid schemes
/ multi-level, channel, and/or network marketing
- Credit or finance management. This includes but is not restricted
to; credit repair, debt relief, stock and/or trading tips, and
mortgage finance
offers
- DJ / nightclub, event / club promotions, and party lists.
- Odds making, betting / gambling services. This includes but
is not restricted to; poker, casino games, horse/dog racing,
college and pro
sporting events.
- Provides material that is grossly offensive, including blatant
expressions of bigotry, prejudice, racism, hatred or excessive
profanity or post
any obscene, lewd, lascivious, filthy, excessively violent,
harassing or otherwise
objectionable
content
- Manufactures, sells, or promotes any products or services
that are unlawful in the location at which the content
is posted or
received
- Introduces viruses, worms, harmful code and/or Trojan
horses on the Internet
- Engages in any libelous, defamatory, scandalous, threatening,
harassing activity
- Posts any content that advocates, promotes or otherwise
encourages violence against any governments, organizations,
groups, or individuals
or which provides
instruction, information or assistance in causing
or carrying out such violence
- Provides content, including copy and images,
of authors, artists, photographers or others without
prior
express
written consent of
the content owner
In addition, MarketAccess reserves the right to prohibit the use of MarketAccess by any company or site in its sole discretion.
As always, sending unsolicited commercial email is FORBIDDEN.
MarketAccess reserves the right to change or modify this statement at

Anti-Spam Policy
MarketAccess has a zero-tolerance spam policy. Any customer found to be using
MarketAccess for spam will be immediately cut-off from use of the service.
If you know of or suspect any
violators, please notify us immediately at abuse@marketaccess.ca.
Every email contains a mandatory unsubscribe link - those individuals who
try to remove this link will be warned that they are doing so. If the link
is removed or de-activated in any way, MarketAccess will terminate the
customer's account.
What is Spam?
Spam is unsolicited email also known as UCE (Unsolicited Commercial Email).
By sending email to only to those who have requested to receive it, you are
following accepted permission-based email guidelines.
What constitutes a Preexisting business relationship?
The recipient of your email has made a purchase, requested information, responded
to a questionnaire or a survey, or had offline contact with you.
What constitutes consent?
The recipient of your email has been clearly and fully notified of the collection
and use of his email address and has consented prior to such collection and
use. This is often called informed consent.
Isn't there a law against sending Spam?
Canada does not yet have a dedicated anti-spam law, but the Personal Information
Protection and Electronic Documents Act (PIPEDA) covers online privacy in detail
and contains many provisions relevant to email marketing. Although a government-initiated
task force recommended specific anti-spam legislation in a 2005 report,
this has yet to bear fruit in the form of an actual law.
How MarketAccess protects you from sending spam
MarketAccess offers a permission-based email-marketing tool that follows the
strictest permission-based philosophies:
- Communication - Your registration page
already states why you are collecting the site visitor's email address, how
you plan to use
their address, and that you are following the embedded privacy policy. Additionally,
by accepting our license agreement you have agreed to use only permission-based
lists and never to sell or rent your lists.
- Unsubscribe - Every email generated from MarketAccess
contains an unsubscribe link which allows your contacts to opt-out of future
emails and automatically
updates your contact lists to avoid the chance of sending unwanted emails
to visitors who have unsubscribed.
- Identification - Your email header information is correct
because it is pre-set for you by MarketAccess. Your email's "From" address
is verified and already accurately identifies you as the sender.
- Contact Information - all of your emails are pre-filled
with your contact information including your physical address.
How to protect yourself from Spam: Take the Spam Test
- Are you importing a purchased list of ANY kind?
- Are you sending to non-specific addresses such as:
* sales@domain.com, business@domain.com, webmaster@domain.com, info@domain.com,
or other general addresses.
- Are you sending to distribution lists or mailing lists which send indirectly
to a variety of email addresses?
- Are you mailing to anyone who has not explicitly agreed to join your
mailing list?
- Have you falsified your originating address or transmission path
information?
- Have you used a third party email address or domain name without
their permission?
- Does your email's subject line contain false or misleading information?
- Does your email fail to provide a working link to unsubscribe?
- Are you failing to process any unsubscribe requests that come
to you via a reply to your email within 10 days or the request?
If you have answered YES to ANY of the above questions you will likely be
